§ 10.12.100. Speed restrictions.

  • A.

    No person shall drive any vehicle upon any street or public highway at a speed greater than is reasonable and proper having regard to the traffic and the use of the way or so as to endanger the life or limb or injure the property of any person. Unless specifically posted otherwise, the following rates of speed shall be applicable and shall be prima facie evidence that the person operating such motor vehicle is running at a rate of speed greater than is reasonable and proper, having regard to the traffic and use of the way or so as to endanger life or limb or injure the property of any person:

    1.

    In excess of twenty miles per hour within the business district as defined in Section 10.08.020 of this chapter;

    2.

    In excess of twenty-five miles per hour within any residential district of the city;

    3.

    In excess of thirty miles per hour on Barker Road from Seventh Street north to the city limits;

    4.

    In excess of thirty miles per hour on Kysor Drive from Route 2 to the end of Kysor Drive;

    5.

    In excess of thirty miles per hour on Colfax Street/Tower Road north from Illinois Route 2/Blackhawk Drive to a point three hundred feet north of the intersection of Mill Road and Tower Road, subject to Section 10.12.250 of this chapter on days that school is in session and children are present so close as to cause a potential hazard;

    6.

    In excess of forty-five miles per hour on Tower Road at a point three hundred feet north of the intersection of Mill Road and Tower Road north to the intersection of Tower Road and Water Road;

    7.

    In excess of thirty miles per hour on Mill Road west of Tower Road to the western most city limits along Mill Road.

    B.

    The fact that the speed of a vehicle is lower than the foregoing prima facie limits shall not relieve the driver from the duty to decrease speed when approaching and crossing an intersection, when approaching and going around a curve, when approaching a hill crest, when traveling upon a narrow or winding roadway, or when special hazards exist with respect to pedestrians or other traffic or by reason of weather or highway conditions, and speed shall be decreased as may be necessary to avoid colliding with any person or vehicle, or on entering the highway in compliance with legal requirements and the duty of all persons to use due care.
