Appendix 302. Fee in Lieu of Detention.

  • All single-family developments under five acres in size and all other developments less than one acre in size are encouraged to pay a fee in lieu of detention. The fee shall be twelve thousand dollars for each acre-foot of detention which would be required under this regulation rather than installing detention facilities on the property. The city shall also have the option for larger properties of requiring that specific properties pay a fee of twelve thousand dollars for each acre-foot of detention needed in lieu of the applicant building a basin onsite, provided that the property will discharge into the city's storm sewer system.

    In instances where regional benefits and economies of scale can be achieved, it will be permissible for adjacent properties to utilize a common regional detention basin.

    Applicants shall have the option of paying a fee of twelve thousand dollars for each acre-foot of detention required, with the approval of the city engineer, to the city so that the city can build regional facilities or the applicant and adjoining properties can jointly build the necessary facilities themselves.
