§ 16.20.050. Dedication of infrastructure.

  • Upon completion by the developer and approval by the city engineer of infrastructure in the new development, the developer may dedicate such infrastructure to the City of Byron by submitting a dedication certificate (appendix F) and a maintenance bond.

    A.

    Maintenance Bond. The developer/contractor shall provide a three-year maintenance bond in the following amounts:

    1.

    In the first year following construction, the amount of the bond shall be twenty percent of the construction cost, or ten thousand dollars, whichever is greater.

    2.

    In the second year following construction, the amount of the bond shall be fifteen percent of the construction cost, or ten thousand dollars, whichever is greater.

    3.

    In the third year following construction, the amount of the bond shall be ten percent of the construction cost, or ten thousand dollars, whichever is greater.

    B.

    The maintenance bond shall be used to ensure that all improvements provided and installed by developer will be properly maintained to the satisfaction of the city. The sufficiency of the bond shall be reviewed by the city engineer who shall make a recommendation to the city council.
