§ 16.55.010. Deviation requests.

  • Where the developer can show that a provision of this chapter would cause unnecessary hardship if strictly adhered to and where, in the opinion of the plan commission and/or planning and development committee, because of topographical or other conditions peculiar to the site, a departure may be made without destroying the intent of such provision, the plan commission and/or planning and development committee may recommend a deviation. Any deviation thus authorized is required to be entered in writing in the minutes of the plan commission and/or planning and development committee, and the reasoning on which the deviation was justified shall be set forth. Recommendation for deviations shall be approved by the city council.

    At the tentative plat stage, a deviation request regarding developments must be brought before the technical advisory staff, who will make recommendations of the deviation to the plan commission and/or planning and development committee.

    A list of all deviation requests and the approval or disapproval of said requests shall be compiled for each development in a single document and kept on file with the plan commission and/or planning and development committee staff. Any deviation requests that arise after the plan commission and/or planning and development committee's public hearing shall be published.
