§ 5.08.275. Prohibited conduct.

    Reporting of Fighting, Disorderly Conduct and Violations of Law. All licensees under this chapter shall have the affirmative duty of reporting immediately to the Byron Police Department any and all incidents of fighting, disorderly conduct or any and all other criminal violations or violations of this chapter, which take place within or upon premises for which a liquor license has been issued pursuant to this chapter. Such report shall be made immediately upon observance or notification of the incident. The licensee, employee or agent making a report of an incident shall identify himself/herself to the police dispatcher and state the nature of the incident. For the purposes of this chapter, "fighting" as used herein shall mean any physical contact of an insulting or provoking nature, or contact that causes physical harm to an individual. For the purposes of this chapter, "disorderly conduct" as used herein shall mean such act or behavior of any person which unreasonably alarms or disturbs another or provokes a breach of the peace within or upon such premises.

    B.

    Inappropriate and Dangerous Occupancy. In order to protect the safety of all persons inside the premises, it shall be unlawful for any person to situate themselves and/or stand upon any object except the floor, stage, or stairs of the premises. No person may be permitted to ascend and remain standing upon any table, chair, bar, or other fixture or object. This section shall only apply during business hours, and shall not prohibit any employee from conducting the usual and necessary business of the licensee.

    C.

    Each licensee, employee or agent who is present and observes any type of criminal activity or fighting, as defined above, is required to immediately notify the Byron Police Department. Failure to report to the police as herein provided shall be a violation of the license issued hereunder.

    D.

    Failure to dutifully enforce this section shall be grounds for license revocation or other penalty deemed appropriate by the liquor commissioner.
