§ 8.32.060. Failure to abate—Penalty.

  • A.

    The person or persons in charge or control of the property, whether as owners, tenants, occupants, lessee or otherwise, who fails to comply with any notice or order to abate any nuisance under the provision of this chapter shall be guilty of a misdemeanor punishable as set forth in the penalty provision of Chapter 1.01 of this code. If any section in this chapter provides provision for a specific remedy and/or penalty, the remedy and/or penalty set forth in this chapter shall control and supercede the penalty provisions of Chapter 1.01 of this code.

    B.

    The person or persons in charge or control of the property, whether as owners, tenants, occupants, lessee or otherwise, of an abandoned gas station as defined under section 8.32.020 of this chapter shall be fined not less than one hundred dollars, and not more than seven hundred fifty dollars, each day that the nuisance continues.

    C.

    In addition to the fine set forth in this section, the owner and/or operator shall be obligated to reimburse the city for any attorneys fees incurred in the prosecution of a violation under this section.
