§ 8.44.020. Prohibition.

  • It is unlawful for any person to cause burning of garbage, metal, salvage, waste or any other material in the city limits, except that the burning of leaves, twigs, branches, grass, and other similar material from residential yards shall be allowed when such burning is conducted in accordance with all other provisions of this code:

    A.

    Such burning shall only take place between the hours of six a.m. and six p.m.

    B.

    Such burning shall take place only between April 15th through May 31st and October 15th through November 30th, such dates being inclusive.

    C.

    No burning of leaves shall be allowed on streets, sidewalks, or alleys.

    D.

    No burning of leaves shall be done in a manner that is hazardous to personal property.

    E.

    The burning of leaves must stop immediately if so directed by the fire or police department of the city.

    F.

    All burning must be supervised by a person eighteen years of age or older and no fire shall be left unattended.

    G.

    No burning of leaves shall be allowed when atmospheric or local circumstances create a hazard to health or safety.

    H.

    All material to be burned must be derived from the property on which the burning is occurring.

    I.

    No burning shall be permitted within two hundred feet of a commercial building or other structure used for general business purposes.
