The performance bond, or any part thereof, shall not be released except upon appropriate
motion by the city council to accept certain improvements. The performance bond shall
not be released until such time that the maintenance bond has been provided. The maintenance
bond shall be released three years after the acceptance of the improvements, if the
improvements have been maintained to the satisfaction of the city engineer and city
council. However, a portion of the maintenance bond shall be released at the end of
year one and year two, as set forth in Section 16.20.050 of this title. All bonds referred to in this title shall be released only upon written
recommendation of the city engineer and approval of the city council.
